Arkansas Publishes Unusually Specific Property Rules

Most states publish a vague line about eligible properties. ADFA publishes rules precise enough to decide a file, which is useful if you read them before you make an offer.

What ADFA lists as eligible

  • Single-family detached, 1-unit, primary residence
  • Planned unit developments, townhomes and condominiums
  • Modular homes
  • Manufactured homes, following FHA, VA or RD guidelines
  • Duplexes — with conditions, below

★ The 5-acre cap

The home may sit on no more than 5 acres of land.

Outside the metro areas this is the rule most likely to catch a buyer by surprise. Plenty of attractive Arkansas listings come with ten or twenty acres, and that property is outside the programme no matter how well the borrower qualifies.

Check the acreage on the listing before you fall in love with it, not after the appraisal.

★ The 15% business-use limit

A business may not occupy more than 15% of the residence.

This matters more than it used to. A home office is fine. A converted front room running a salon, a workshop taking up a substantial share of the square footage, a property marketed as live-work — those can breach it.

If part of the house is used commercially, raise it early. It is a measurable test against square footage, so it is answerable up front rather than being a judgement call at underwriting.

★★ Duplexes, and the targeted-county exception

ADFA's duplex rules are specific, and all of these apply at once:

  • You must be purchasing both sides.
  • FHA financing only.
  • You must occupy one side.
  • The property must be at least 5 years old.

And the exception worth knowing: duplexes in a targeted county may be newer than five years.

That is a second, quieter benefit of the thirty targeted counties beyond the first-time waiver — and for a buyer looking at a new-build duplex to live in one side and let the other, it is the rule that decides whether ADFA financing is available at all.

And the first mortgage has its own rules

ADFA's property rules sit on top of whichever first mortgage you use. FHA, VA, Rural Development and conventional each have their own condition and property standards, and an appraiser works to those. Clearing ADFA's list does not by itself clear the loan underneath.

Can I use ADFA assistance on a home with acreage?
